商标的R标和TM标的区别：
（1）注册表达
用TM则是商标符号的意思，即标注TM的文字、图形或符号是商标，但不一定已经注册（未经注册的不受法律保护）。 而R是REGISTER的缩写，用在商标上是指注册商标的意思。
（2）特征含义
R是REGISTER的缩写，用在商标上是指注册商标的意思。用圆圈R，是“注册商标”的标记，意思是该商标已在国家商标局进行注册申请并已经商标局审查通过，成为注册商标。
TM有其特殊含义,TM标志并非对商标起到保护作用,它与R不同,TM为TradeMark的缩写，既包含注册商标R，亦包含直接使用未经商标局核准注册的未注册商标。
（3）法律保护
R标具有排他性、独占性、唯一性等特点，属于注册商标所有人所独占，受法律保护，任何企业或个人未经注册商标所有权人许可或授权，均不可自行使用，否则将承担侵权责任。
TM标，能够起到一定的保护作用，但若该商标未经商标局核准注册，其受法律保护的力度不大，只有当该未注册商标达到一定知名度的情况下，才能够一定程度上获得法律保护。
（4）TM和R的差别
区别一：使用时间不同：我们使用的商标在未成为注册商标的时候，就可以标注“TM”进行标记。当商标成为注册商标后，就可以在其右上角或右下角标注“R”或“注”注册标记，或者直接标明是“注册商标”，TM使用时间早于R。
区别二：价值不同：TM是一种通用商标使用，没有进行商标保护；而注册商标R则是在长时间使用过程中沉积下来的富含产品知识品牌内在价值的内容，具有很深的影响力和传播力。拿到注册商标证书后，商标使用者享有专用权，企业通过商标树立品牌，推广企业。R商标的价值大于TM商标。
区别三：法律意义不同：这两种都在表示文字或图形标识的商业标识，用于商业活动中。不同的是TM商标不具备法律保护，申请注册商标时，享有使用在先的权利；R商标具有商标保护的法律意义，商标使用者拥有专用权。
